GENERAL TERMS AND CONDITIONS FOR SPORTS TRAINING SERVICES
1. Identification of the Service Provider
This document regulates the terms and conditions for the services offered by Aguait Fit (hereinafter, "the Center"), with registered address at Carrer Venderol 10, NIF Y9910468N, and contact email address info@aguaitfit.com.
2. Purpose of the Services
The Center offers outdoor group training services, including functional training, calisthenics, strength and hypertrophy training, CrossFit, and Hyrox sessions (hereinafter, "the Services").
Registration for any of the activities implies full acceptance of these Terms and Conditions.
3. Conditions of Participation
The participant declares that they are in adequate physical and health condition to engage in physical exercise. In the event of any illness, injury, or medical condition, the participant agrees to inform the Center before the start of the activity.
The Center reserves the right to deny participation if it deems the student unfit to participate in the training.
4. Liability and Release
The participant acknowledges that physical exercise involves an inherent risk of injury or accident.
The Center and its trainers are not responsible for injuries, ailments, aggravation of pre-existing conditions, or physical or property damage resulting from training, except in cases of negligence or gross non-compliance attributable to the Center.
The participant expressly releases the Center from all liability arising from their participation, assuming the practice of sports at their own risk.
5. Weather Conditions and Cancellations
Classes are held outdoors, so they may be affected by adverse weather conditions.
In the event of heavy rain, a storm, or any other circumstance that prevents safe practice, the Center may:
a) Reschedule the session to a new date and time, or
b) Offer an alternative (online session or compensation voucher).
No refunds will be issued in the event of cancellation due to weather conditions, provided a reasonable alternative is offered.
6. Cancellations and Refunds by the User
Reservations or registrations are non-refundable once the contracted period has begun.
In the event of a justified medical leave, a temporary suspension or compensation may be requested, at the Center's discretion.
7. Use of Image
The participant authorizes the Center to capture and use images, photographs, or videos taken during the activities for promotional or advertising purposes on social media, the website, and corporate materials, without the right to financial compensation.
If the participant does not wish to grant this authorization, they must notify us in writing before the start of the activity.
8. Rules of Conduct and Safety
The participant agrees to follow the instructions of the coaches and maintain a respectful attitude toward other members of the group.
Failure to comply with these rules may result in expulsion from the program without the right to a refund.
9. Personal Data Protection
In accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), the Center informs that the participant's personal data will be processed for the purpose of managing registration and providing the contracted services.
The data controller is [Name of Center].
The data will not be disclosed to third parties except under legal obligation.
The participant may exercise their rights of access, rectification, deletion, and objection by sending an email to info@aguaitfit.com.
10. Modification of Terms and Conditions
The Center may update these Terms and Conditions by publishing the revised version on its website. Modifications will take effect upon publication.
11. Applicable Law and Jurisdiction
This contract is governed by Spanish law.
The parties expressly submit to the courts and tribunals of Palma de Mallorca for the resolution of any dispute arising herefrom.
